Affiliate Program Terms
These terms are an agreement between you ("Affiliate") and Joshua Newton d/b/a Digital Envisioned, 106 Center Street South, Birmingham, AL 35205 ("we", "us"). By creating an affiliate account you accept them.
1. Joining
Joining is free. You must be 18+, give accurate contact and payout details, and keep them current. We may decline or close any account at our discretion, for example for violating these terms.
2. Commissions
- Standard rate: 40% of the net amount we actually collect (excluding taxes and processing fees refunded or reversed) on eligible products bought through your link.
- Elite rate: 45% while you have 10 or more approved sales in the trailing 90 days.
- White-label reseller licenses: 35%.
- Subscriptions: commission on each paid renewal for the first 12 months of the referred subscription.
- Rates may change with 30 days' notice; changes don't affect commissions already earned.
3. Attribution
Sales are tracked with a first-party cookie lasting 60 days from your most recent click, last click wins. We also attribute via checkout reference parameters. If tracking fails because a visitor blocks cookies or uses another device, we may not be able to credit the sale. Our records are final for attribution.
4. Reserve, chargebacks and reversals
All sales are non-refundable under our sales policy, but card chargebacks and payment reversals still occur. Each commission is therefore held for 30 days ("reserve") before it is approved. If a payment is charged back, reversed or found fraudulent, the related commission is cancelled, or deducted from future payouts if it was already paid.
5. Payouts
Approved commissions are paid monthly by PayPal once your approved balance (after adjustments) is at least $100. Balances below $100 roll over. You are responsible for any taxes on your earnings; we may request a W-9 (US) or W-8 (non-US) before paying, and issue a 1099 where required.
6. Not eligible
- Purchases by you, your household, or businesses you own or control.
- Sales from spam, misleading claims, cookie stuffing, forced clicks, incentivized or fake signups.
- Paid search ads bidding on "Digital Envisioned" or our product names, or ads impersonating us.
- Coupon/deal sites we haven't approved.
7. FTC disclosure (required)
Under the FTC Endorsement Guides (16 CFR Part 255), you must clearly and conspicuously disclose your financial relationship with us wherever you promote us — close to the link or claim, in plain words, e.g. "I earn a commission if you buy through my link." In video, say it out loud and show it on screen. Don't hide it behind "more" links or in a hashtag cloud.
8. Honest promotion
Don't make income, earnings, savings or results claims about our products or this program that we haven't published. Don't create fake reviews or testimonials. Don't represent yourself as us or as our employee. Use only our approved assets or your own truthful content. Follow the CAN-SPAM Act and TCPA (no unsolicited texts or robocalls).
9. No guarantee of income
We make no promise that you will earn any money. Most affiliates earn little or nothing. Any figures we show are examples or arithmetic, not typical results.
10. Independent contractor
You are an independent contractor, not an employee, partner or agent.
11. Limitation of liability
To the maximum extent permitted by law, our total liability under this program is limited to the unpaid commissions owed to you. We are not liable for indirect or consequential damages. The program and its tools are provided "as is".
12. Termination
Either party may end participation anytime. Approved commissions earned in compliance with these terms are paid in the next cycle if they meet the minimum; commissions tied to violations are forfeited.
